The following terms and conditions do not affect your statutory rights as a consumer:
You must be aged 21 years or over and have completed either the login procedure or have completed an account application form (available by post) before goods may be despatched. You are responsible for the safekeeping of your user name and password and all orders made under such. You must notify us immediately of any known unauthorized user or any other possible breach in security.
All goods remain the property of 1-877-SPIRITS.com until payment is received in full. All persons placing an order will be sent a receipted invoice upon request.
You are able to purchase goods using various payment cards via our secure server, which utilizes the latest 128-bit SSL encryption technology to inhibit the likelihood of unauthorized access or disclosure.
Guarantee:
The company undertakes to give you the best service possible but do not accept responsibility for uninterrupted services whilst 'on-line' due to technical problems outside of our control and are therefore unable to guarantee entirely error free services.
1-877-SPIRITS.com shall not be liable for loss of wasted expenditure, loss of business, or earnings as a result of using our services.
Cancellation of Services:
We reserve the right to terminate you using our services at any time, for whatever we consider misappropriate or improper use or not abiding by these terms and conditions. You will be informed of such termination in writing.
Copyright:
All rights in the design applications and any items contained within this site including its trademarks, intellectual properties, pictures and any text are solely owned by 1-877-SPIRITS.com and may not be used for any other purpose.
Credit Terms:
Trade invoices are due for payment by 14 days end of month from the month of invoice (or such other period as may have been agreed in writing between the customer and 1-877-SPIRITS.com).
1-877-SPIRITS.com reserve the right to withdraw credit facilities and to charge interest at the rate of 3% over base rate on overdue accounts.
1-877-SPIRITS.com also reserves the right to refuse to make any further deliveries until such time that any overdue monies are paid. If the buyer fails to pay any one invoice that has become due, then all other unpaid amounts shall become due immediately. In this event, the company reserves the right to withdraw from any further delivery obligations without further notice, and be entitled to claim compensation for any and all damages suffered, including any charges or fees levied to 1-877-SPIRITS.com's appointed collector of any, and all debts outstanding.
Retention of Title:
Notwithstanding delivery and the passing of risk in the goods or any other provision of these conditions, all goods delivered by 1-877-SPIRITS.com and the title in any goods shall not pass to the customer until all monies that are outstanding at any time including bank charges, legal fees and collection expenses are paid to 1-877-SPIRITS.com in full in cash or cleared funds. In this regard the customer grants the right to 1-877-SPIRITS.com to enter the customer's premises, or in any other premises where the goods are reasonably believed to be stored by the customer when notice has been given to take possession of the goods, or at any time using such reasonable force, in accordance with US law as may be required in the event that access is not permitted for any reason by the customer.
Until such time as title in the goods has passed to the customer, the customer shall hold the goods as 1-877-SPIRITS.com's fiduciary agent and bailee, and keep the goods properly stored, protected, insured and identified as 1-877-SPIRITS.com's property. Until that time, the customer shall be entitled to resell or use the goods in the ordinary course of business but shall account to 1-877-SPIRITS.com for the proceeds of sale or otherwise of the goods, whether tangible or intangible, including insurance proceeds and shall keep all such proceeds properly stored, protected and insured.
Until such time as title in the goods passes to the customer (and provided the goods are still in existence and have not been sold). 1-877-SPIRITS.com shall be entitled at any time to require the customer to deliver up the goods to 1-877-SPIRITS.com or their agents and, if the customer fails to do so forthwith, to enter upon any premises of the customer or any third party where the goods are stored and repossess the goods. The customer shall not be entitled to pledge or in any way charge by the way of security for any indebtedness any of the goods which remain the property of 1-877-SPIRITS.com, but if the customer does so all monies owing to 1-877-SPIRITS.com or the invoicer by the customer shall (without prejudice to any other right or remedy of 1-877-SPIRITS.com or the invoicer) forthwith become due and payable.
Undertaking:
We shall undertake to correct any inaccuracies so pointed out to us and to amend these as soon as possible.
Return Policy:
Items purchased at 1-877-SPIRITS.com may be returned by mail, unless stated otherwise in the prior written notice. Items must be returned in the original manufacturer's packaging. Items purchased from a marketplace retailers cannot be returned to 1-877-SPIRITS.com; they must be returned to their marketplace retailer in accordance with their returned policy. Items purchased from dealers or resellers and not 1-877-SPIRITS.com directly are not eligible for return, refund, or exchange. 1-877-SPIRITS.com will accept, for return or exchange, items that are in new condition, unused, unopened, free of damages by the customer. Items cannot be returned or exchanged after 15 days from the original receipt date. Items must be returned with all 1-877-SPIRITS.com tags still attached and must be in their original packaging.
To create a return request, contact us via email at
[email protected] with reasons. Once return request received via email, one of our gift concierge will email back with return label to be returned. You can use the original packaging and use non-descriptive box to return the package. Once we receive the package, we will inspect to see if there's any usage, undamaged, and unopened. After inspection, 1-877-SPIRITS.com will refund the full amount, excluding SHIPPING CHARGE, TAX, and/or RESTOCKING FEE (No greater than 15%), if applicable, back to the original credit card used.
Damaged Items:
Proof of verification is required for all damaged items during transit. Contact us at
[email protected] with photo of damaged items and one of our gift concierge will be in contact and discuss next steps.
Refund Initiation:
Refund initiation process takes about 3-10 business days, depending on the credit card using bank. Once refund initiated, you will receive a refund notice via email originally used to place the order.
No Refund:
Custom Engraved Items are not eligible for refund. Items that are damaged, used, and/or no original boxes are not eligible for refund. Items that are more than 15 days from the original receipt date are not eligible for refund. Some items marked "Final Sale" in the product description are not eligible for refund.
These conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the courts of England and Wales.
